History

House Bill 523, effective on September 8, 2016, legalized medical marijuana in Ohio. The Ohio Medical Marijuana Control Program allows people with certain medical conditions, upon the recommendation of an Ohio-licensed physician certified by the State Medical Board, to purchase and use medical marijuana.

Three state government agencies are responsible for the operation of Ohio’s Medical Marijuana Control Program: Ohio Department of Commerce, State of Ohio Board of Pharmacy, and State of Ohio Medical Board.

Certificate to Recommend (CTR)

DOs with a full, unrestricted Ohio license are eligible to apply for the certificate to recommend. There is no fee for the CTR. Full requirements are outlined in HB 523 and medical board rules OAC 4731-32, and include annual completion of an OOA-approved (or OSMA-approved) two-hour CME course on the subject. Specifically:

The applicant has completed at least two hours of continuing medical education in a course or courses certified by the Ohio State Medical Association or the Ohio Osteopathic Association that assist physicians in both of the following:

(a) Diagnosing qualifying medical conditions as defined in section 3796.01 of the Revised Code;

(b) Treating qualifying medical conditions with medical marijuana, including the characteristics of medical marijuana and possible drug interactions.

Details about obtaining a certificate to recommend (CTR) under the Ohio Medical Marijuana Control Program are on the Medical Board website.

Resources and other information for physicians are available on the MMCP website.
